2021 Client Seminar on Estate Planning, Real Estate, and Elder Law Issues

 We invite you to attend a seminar specifically designed for our clients. There have been a significant number of changes to the estate planning rules, the role and use of powers of attorney, long term care and “elder law” planning, and Medicaid eligibility over the past several years.  This year our client seminars will revisit some of the changes, and take a look at the practical impact of these changes on you and your estate plans.  The following is a list of some of the topics that will be visited at each of the estate planning seminars: 

  • So you want to “Avoid Probate” for your house upon death.  Should you give the house to your children while you are still alive, use a “Transfer on Death” affidavit, use a Trust, or just rely on a Last Will and Testament?  The pros and cons of each.
  • A refresher on the status of the Federal Estate Tax and “basis” step-up rules: Why the estate tax is relevant for even small and modest estates. 
  • Beyond a review of your Trust or Last Will & Testament: The importance of reviewing how your assets are titled.
  •  
  • Do I still need my trust?
  •  
  • Understanding the role, responsibilities, and obligations of a person acting as a health care agent under a Living Will or Health Care Power of Attorney.  The need for HIPAA waivers and authorizations. 
  • You have a Durable Power of Attorney to help you with finances.  In Ohio, banks and brokers are permitted to accept a power of attorney, but they are not required to do so.  What happens if the bank will not accept the power of attorney?

  •  Your child is going to college.  Do they need to have an estate plan?  What estate plan documents should a child, even without any assets, have in place?
  • Update on Medicaid eligibility requirements and its impact on planning for Long Term Nursing Home costs.

  •  Considering a move to Florida?  A discussion of some practical and legal considerations; seasonal and permanent.
